1. The Appellant lodged an appeal in the High Court under Section 289 of the Town and Country Planning Act 1990 against the decision of the First Respondent’s Inspector given by letter dated 26th November, 1997 whereby he had dismissed an appeal against an enforcement notice issued on 18th October, 1996. The Section 289 appeal was dismissed by His Honour Judge Rich QC sitting as a Deputy judge of the High Court on 27th October, 1998. I have been asked to advise on the merits of a further appeal to the Court of Appeal against that decision.
